1 About and Definitions

Foxmike AB, org. no. 559150-6497 (“Foxmike”, "us", "we", or "our") operates the www.foxmike.app website and the Foxmike mobile application. These Terms constitute ("Agreement") between you and Foxmike (as defined below) governing your access to and use of the Foxmike website, including any subdomains thereof, and any other websites through which Foxmike makes its services available (collectively, "Site"), our mobile, tablet and other smart device applications, and application program interfaces (collectively, "Application"). The Site, Application and Foxmike Services together are hereinafter collectively referred to as the “Service”.

The Foxmike Platform is primarily an online marketplace for group training sessions (“Sessions”) that enables registered Members (“Members”) a variety of services related to this Service. Members can offer Sessions to other Members. Members that offer Sessions we hereinafter refer to as “Trainers” and Members that participate to Sessions we hereinafter refer to as “Participants”.

2 The Service

Foxmike is usually provided all day, every day of the year. However, Foxmike does not warrant that the Service is free from errors, outage and disruptions for any reasons. Foxmike reserve the right to close the Service for maintenance.

Any Session offered by Members and not explicitly stated that Foxmike is the organizer, then Foxmike solely act as an intermediate and cannot take any responsibility for its quality or delivery.

Members alone are responsible for identifying, understanding and complying with all laws, rules and regulations that apply to their offering or participation at Sessions.

3 Booking and Session Information and Fees

3.1 For Participants

When booking a training session, there may be a charge for the Participant. When charged for a Sessions. A cancellation can be made against a cancellation fee, if within 30 minutes from the time it was booked or not within 6 hours from the time the activity is scheduled to start. If the cancelation is not made within 30 minutes from the time it was book or six hours from when the Session is scheduled to start, then no refund is made. The cancellation fee is to cover our transactions cost to our payment provider. The cancellation fee varies between countries and depends on the amount that was payed.

If the Trainer cancel or don’t or deliver the Session, then the Participants will be fully refunded. If you wish to make a complaint about the Trainer, please email us at info@foxmike.app.

Certain information may be changed or added to the Training Sessions by the Trainer or us. We may inform the Member if given permission by the Member in the mobile settings. Foxmike cannot be held responsible for any changes made to the Session and if the Member has not been informed of it.

Personal belongings brought to training sessions are the responsibility of the Member, no legal claim can be made to other parties due to loss, damage or other reason.

Please keep in mind that all Sessions where it’s not clearly stated that Foxmike provides the Session, are provided by other parties, and if so, Foxmike have no part in their product and hence no responsibility for it.

3.2 For Trainers

Foxmike Members may apply to become a Foxmike Trainer. Trainers may offer Sessions, group training activities to other Members for free or for a charge per participant and Session.

To become a Trainer, Foxmike may charge a deposit from the Trainer, the required amount varies for different countries. This deposit may be collected from the Trainer if he or she doesn’t deliver the Session as advertised. By doing this, we intend to make sure that the Trainer arrives in time and deliver what she or he has advertised. We will be reluctant to collect the deposit if the Trainer held the Session at all. We will however investigate every complaint we receive. The deposit is normally returned at full within five days when asked for. After the deposit is asked back the Trainer may not hold Sessions anymore at the Foxmike Platform. The third time you deposit to become a Trainer, we check that it is not within 30 days from the time last time you withdrew your deposit.

When Sessions has been booked and payed for, Foxmike may charge a service fee. The fee may vary from 0% to 20% of the amount due to the Trainer from the Participants. Payouts to the Trainer after fees is generally made 16 days from the time it was booked. Therefore, the full amount may not be received until 16 days after the Sessions was held.

The Trainer may use additional help from one or more people to help organize their activity.

The Trainer may cancel the training session if not within 24 hours before the training session is scheduled to start against a cancellation fee from 0% to 10%. If the Session is cancelled 24 hours before the Session, the Trainer may be charged the deposit.

Foxmike reserve all rights to suspend and remove any Session, Trainer, Member for improper behavior or any other reason. When a Trainer is suspended or removed we may collect the deposit.

4 Ratings and Reviews

After a Session has been completed then the Participants can leave a public review and submit a star rating about the Trainer. Ratings or reviews reflect the opinions of individual Members and do not reflect the opinion of Foxmike. Ratings and reviews are not verified by Foxmike for accuracy and may be incorrect or misleading.

5 Safety

Members are responsible for their own safety. Foxmike wish to make group training better and safer. Since we do believe some people restrain from running alone, we hope we can provide a safe alternative. However, Foxmike is a marketplace and cannot be responsible for the Sessions and any activity advertised on our Services. Safety should always be considered, and every Member is responsible for their own safety. Members are obliged to comply with applicable law, safety and order rules, to follow the instructions given by the Trainer regarding methods and equipment. Foxmike carries no responsibility for accidents and injuries that occur on Sessions, or any activity linked to our Services. The Member is responsible for ensuring that his/her health condition is good enough to partake in any Session advertised on our Services.

6 Data Protection and Privacy

Protection of Personal Data is very important to us. Our Privacy Policy explains how and for what purposes we collect, use, retain, disclose, and safeguard the Personal Data you provide to us. You agree to review the terms of our Privacy Policy, which we update from time to time.

Foxmike is not responsible for the privacy policies and procedures applied by ad networks and other sites, by third parties with whom we collaborate to provide personalized services or those accessing Member Information on our Service

We strive to provide a secure environment by trying to restrict access to our database to legitimate Members, but we cannot guarantee that unauthorized parties will not access it. We also cannot control how authorized Members store or transfer information that Members give us. Therefore, MEMBERS SHOULD NOT PROVIDE SENSITIVE INFORMATION ON THE FOXMIKE PLATFORM.

7 Member-Generated Content

Foxmike Members may post, upload or otherwise contribute content to the Service. Which may include, pictures, videos, text, messages, information, descriptions and/or other types of content (“Member Content”).

You promise that any Member Content you post on Foxmike, you own or have the legal right to post such Member Content. Foxmike reserve the right to remove any Member Content for any or no reason. Foxmike may take these actions without any notification. Foxmike is not responsible for Member Content.

8 Content and Documentation

You hereby give your permission to be documented in text, film and image or any other form for marketing or for any other reason.

9 Tax Consequences

Purchases and sales of assignments and services may entail various types of tax liability. The responsibility for declaration and taxation always lies with the Members themselves and Foxmike is not responsible to any extent for any tax effects arising as a result of the use of Foxmike Services. Foxmike refers Members to the Tax Agency for information on tax issues.

10 External Partners

It is possible to register as a Member via Facebook and Google. Foxmike will not, without the Members permission, post anything on Members Facebook or Googles pages.

Foxmike may need to use the map and satellite photo service conventionally called "Google Maps" [Google Maps], a service provided by Google, Inc., 1600 Amphitheater Parkway, Mountain View, CA 94043, USA ("Google").

When a Member activates the "Locate Me" feature in Foxmike, Google may collect and process information about the Member's current geographic location. Depending on the Member's hardware capabilities, Google may also collect information on nearby Wifi routers, cell identities in the mobile tower closest to the Member, and the strength of Wifi or mobile signals. Google uses this information to return an estimated location to the Member's mobile browser, and the browser will then announce the estimated location to Foxmike. For each individual request sent to Google Location Service, Google may also collect information such as the Member's IP address, the Member's agent, and the Member's unique customer identifier. According to Google, this information is used to separate requests from each other, not to identify Members personally.

The Foxmike Platform may contain links to third-party websites or resources. Such Third-Party Services may be subject to different terms and conditions and privacy practices. Foxmike is not responsible or liable for the availability or accuracy of such Third-Party Services, or the content, products, or services available from such Third-Party Services. Links to such Third-Party Services are not an endorsement by Foxmike of such Third-Party Services.

11 Changes to These Terms and Conditions

We may update our Terms and Conditions from time to time. We will notify you of any changes by posting the new version on this page. You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.
